View Full Version : My cat was killed in neighbors yard

I received a call from my neighbor that my cat was attacked by a armadillo in her yard. Went over to get her and her tongue was hanging out of her mouth. We rushed her to the hospital. She had a broken back, broken pelvis and a punctured lung. The vet put her down. I am now being sued by my neighbor because she tried braking up the fight and got scratches on her arms and legs. My homeowners insurance does not cover my cat. Two days before this incident we told the neighbor that her og or something was digging under her fence. We purchased a bag of lava rocks for her to put in the hole. The evening of this incident, the lava rock was still sitting in the bag on her porch. Will she win this lawsuit? And by the way, our vet said my cat was injured by a large dog and not an armadillo. She has a large dog.

You have a duty to keep your cat in your yard. So yes she may sue you for damages if your cat and dog was fighting and she tried to break them up.

Your home owners should cover the cat, most cover normal household pets unless they are a dangerous breed.

But then you have a obligation to keep the cat in the house or on a lease so it does not leave your yard.

If for example your cat went over and walked on someone's car and scratched the car, you can be held liable for the damages

Depends on the judge... after all your cat was on HER property when it happened... and it DID scratch the crap out of her...

In some localities that's all they need to prove to win.
