My landlord sent me a lease violation stating that I have people living in my apartment that are not on my lease. The only people living in my apartment and on my lease is two kids and me. My boyfriend comes over several times to watch our kids while I work and to spend time with us but he does not spend the night nor is there any evidence that he lives with me. Can I be threatned with eviction with no evidence and false statements?

The violation notice should include a date by which you can cure the violation. If its not cured then he takes you to court. You can then fight it by asking him for proof that your boyfriend lives there. You can show proof that your boyfriend has his own place to counter.

But even if you win, you should plan on moving, since if the landlord wants you out, he can make life miserable for you.

I would first sit down with the landlord and ask why he thinks your boyfriend is living there. Maybe he got bad info from a neighbor. So maybe you can settle this amicably.

I agree, most likely someone has complained about him being there. Perhaps he parked in someone else's space a few times ? Or landlord has seen him in and out a lot.

Time to talk to them as to why they believe this, it will up to them to prove their case in court for eviction if it goes to court
