My lease ended January 22nd 2013, and I gave a written letter staying I was leaving three months ago. More my landlord states that they do not have that letter or even recall me giving them the letter. What can I do?

Did you move? Do you have a copy of the letter? Any proof you sent it? What does the lease say about notification on expiration?

Already moved out completely even paid the current month rent, can not find a copy of the letter, which of course means no proof of sending it. So right now its my word against theirs, currently they are trying to make me pay by the week until they get a new tenant in the apartment. I was wondering legally in the state of North Carolina since I sent the letter and my lease ended January 22nd and I have paid all rent up until now do I still need to pay weekly. Not quite sure what lease really states.

Frankly, I would not pay and tell them to sue you if they want. But I would check the lease first. If they made no contact with you about renewing the lease, I think a court would side with you, even without proof. At the worst, the court might award them an additional months rent, since, when the lease expired you became a month to month tenant so would only be responsible for another month.

My feeling is they won't go to court over this.
