View Full Version : Can I move out of state without my ex husband's consent

I just got granted a divorce after 15 months. In the divorce I was granted sole custody of our 6 year old daughter. He has one visit per week for 7 hours on Sunday and must be supervised. He is currently being charged with possession of child pornography, pictures of our daughter. I would like to get a fresh start and go back to school and there are some great schools where my boyfriend lives; but it's 2000 miles from where I am now. I want to know how to go about this the best way. Will I need to get an order from the court to move? I assume if e is convicted and goes to jail I won't need his permission?

You have to file for relocation.

Even if he is convicted and jailed, you will still have to go to court. Since he has court ordered visitation, then you would be defying the court order and be guilty of contempt of court if you move preventing him from exercising his court ordered rights.

However, given the circumstances, if you go back to court, show his arrest record, especially if you wait for a conviction, there is a very strong chance the court will modify the order and give you permission to move.

But if you defy the court and move without permission, the court will not like that.

You should have no trouble getting permission of the court if he is convicted. But you will need court permission
