I have completed a DNA test which has come back positive. My daughter is now 6 months old and both myself and her biological mother wish to live together and bring up our child. The problem is that her ex husband will not hand over my daughter and will not even allow me to see her. He has refused to let the biological mother take my daughter out of his parents house which is where they were looking after my daughter for him.

I am from the UK and my daughter and her mother are living in Poland. Does her ex husband have any rights knowing that he is not the biological father? I really want to not only see my daughter for the first time but both her and her mother to come and live with me in the UK.

Please I need some advice, as I am unsure how I can get this man to release my child.

Were they married when the child was born or conceived? Not sure of Polish law, but in the US, if the child was born under those conditions the husband is the legal father.

Was the DNA test court ordered or part of a court proceeding? Is the husband on the birth certificate?

Until and unless a court issues an order that you are the legal father, the husband may have control over the situation.

The laws vary from state to state.I am not sure what the laws in Poland are...
