My girlfriend is still legally married and got pregnant by me, but her husband signed the birth cerficate. She is now taking me to court to pay child support. What are my rights to the child and I'm held responsibly for child support. There has not been a DNA test done yet. If she is mine I want to change her last name... Is there a time limit because my child just turned 2 years old.

ANY question on law needs to include your general locale as laws vary by area.

Under the law in all US states, when a child is born to a maried couple, the husband is presumed to be the legal father.

Before she can pursue you for support you have to be assigned to be the legal father by a court. Whether that can be done legally at this point in time will depends on the local law and other circumstances.

I would suggest you get an attorney to advise you of your rights and obligations here.

GA law allows the mother to bring an action challenging paternity. So part of the court proceedings should be a dtermination of paternity using pproved medical testing.

If you are proven the father, then the mother can get child support. You can counter sue for visitation, changing the birth certificate, etc.
