View Full Version : Bank is foreclosing on builder that owns our house

We live in a house we furnished for a showhome company that helps for builder to sell. We pay monthly fee to company and they pay builder. We were told today that the bank is forclosing on builder ASAP. Maybe January 1. How long do we have to find another place?

We have agreement with Showhome Co. We pay them a fee to decorate and show the house anytime. The Builder told us the Bank is foreclosing any day. Can they evict us immediately or do we have time to find other place? Do we have any rights? Please help.

Under current federal law you must be given at least 90 days notice. If the contract you have has an expiration date its possible the new owner must owner that date.

When the bank files suit to foreclose, you should be served with the paperwork as an occupant. Thus you will know when the clock starts ticking. You should also be given a 90-day notice. When the foreclosure sale happens (I don't know for sure how long that may be in Georgia, but here in Floriida it often takes several years) a writ of possession can also be entered, authorizing the sheriff to kick you out.
