View Full Version : Can I dismiss / correct the wrong car accident report issued by policer officer?

I was invloved in a car accident months ago in NJ and been issued a completely wrong accident report by the police officer and got a ticket. I made the complaint right after I saw the report and filed a complaint against the other person invloved in the accident as well. We got dual dismiss for our ticket on the court. But the accident report is still there and remain wrong.
My question is:
1. will this report still has any legal power to be used in any case (court case or insurance case etc.) in the future? Or it just could not be used as evidence anymore at anywhere becase the ticket is dismissed?
2.If the report is till usable, then can I correct it? Dismiss it? Cancel it?
3.how can I do in order to cancel the report?
4. Is there any other influence for me that may caused by the wrong report?

An accident report made by a police officer is nothing more than a written version of the results of his or her investigation. If there is litigation the officer may testify, and the report may be relevant in determining what the court will believe. Usually it isn't even admissible unless the officer is present and testifies in court.

A accident report is what the officer claims to have seen and what other witnesses have stated, nothing more or less. It is used for traffic tickets, but since they are dismissed there is no longer any criminal issue to the report.

Yes for civil cases the insurance company will use it ( and most likely already has and any claim should be final by now ?)

You can not change it, it is the way it is. You can in most places ask to add a supplemental report stating what you know ( not what you think happened)

Yes another person involved in the accident showed the report to our insurance company before we could do anything about the report, and our insurance company paid for her already, that really make us feel upset because this report is NOT true, the police offerice stated some words that I never said.

Can we still have a chance to correct the report and cancel the influence on the insurance company's side?

How can we file a supplemental report in NJ?

That is between you and your insurance company. It will have nothing to do with somehow modifying the report itself; rather you have to persuade the insurer not to raise your rates based upon an inaccurate report.
