Live in Florida.. Can we file child abandonment if the other parent has not had contact or kept her visitation rights with the child. Father and mother have a parenting plan which indicates the father has the child Friday at non to Monday at noon, the mother has the child Monday to Friday. However since the parenting plan/mediation in 7/12 to present the mother has seen the child a total of 5 times and has not seen her since holloween, over a month. The child has been living with the father and the grandparents since the middle of June.. Btw. Father is paying child support as well. So mother is receiving child support for the child who she does not see. What can we do?

You can't force a parent to follow a visitation schedule. However, support is awarded to the custodial parent. If the mother is no longer the custodial parent, then the father should go back to court and file for a change of custody and modification of the support order.

If the parent who does not have custody has the child physcially and has for 5 months, they need to file in court for a modification of the custody and of the support order
