Can my husband adopt my son? My child's father is a pedophile and his crime case is recorded sealed. I live in the state of California. He doesn't pay child support and doesn't visit my son. No calls and I mean nothing. No effort at all. We know his where about. So what can my husband and I do? We also discussed about changing my son's name.

I would definitely consult a family law attorney to prepare the adoption. In most cases the court will require that you contact him to get his signature on a relinquishment of his rights to clear the way for the adoption. In your case, the court MIGHT waive this requirement, but it would take a knowledgeable attorney to properly prepare the paperwork. Even if they do require trying to get him to agree to the adoption, if he refuses, I believe they will issue an involuntary TPR (Termination of Parental Rights) in your case.

Getting a court to issue a TPR is usually very difficult. But given your circumstances of a) having your husand adopt and b) his sex offender status will make this happen for you.
