My boyfriend and I have a joint bank acct, our 4 yr old gets social security benefits and today our bank account was frozen due to back child support. The only money that goes into our account is my paycheck every week and our son's social security. Can the state of Florida keep that money?

We need more information about your situation but in the mean time you should open a separate account in your name only. Have your checks and SS go there. Who is paying child support to who and why?

The answer is maybe. I'm going to assume that your boyfriend owes child support and is in arrears. So the state was within its rights to seize any asset that your boyfriend is listed as an owner. The state doesn't know the source of the funds, only who is listed as owner.

What you have to do now is get a copy of the order served on the bank to freeze the funds. You then have to go to the court or agency that filed the order and file to have the order vacated on the gorunds that your boyfriend contributed nothing to the account. You will have to prove the source of the funds.

And get your boyfriend's name off the account. Were you aware he owed child support?
