View Full Version : What to know before going to court for child support

I am a single father supporting the mother of my child and her as well in apartment with my name on it along with the light bill, phone bill, and rent. I've already given up my apartment key so that I can avoid her personal space. Me personally I feel if I don't live there I shouldn't be paying rent and bills so that she can live nice. She is on food stamps works a low income job and gets assistance from the government from daycare. We have not gone to court yet but I eventually know we will because she likes to lie about everything and keep making up stories about what I'm doing when I am following what she told me to do. I have reciepts showing that I am paying for her and our child. But I know the court system here in Illinois is set for women.

Will I have to pay child support even though I am already paying for everything else for her including our child?

If you are living together then you have the child just as much as she does. So there is no need to set support except that based on income. The courts may ask for some but it should be minimal as the child is with you full time also.

Rule ONE. Hire an attorney
Rule TWO Do what attorney says

Paying her bills or bill of child is not child support that is gifts, A check written to her with child support written on the check, is child support. Anything else is gifts

So stop paying her bills, don't have her live in YOUR apartment, since you are liable for it.
File for visitation with child and get support set in court and give her only that money
