I was granted custody of my 16 year old son and 14 year old daughter five years ago. My children lived with me for 2 and a 1/2 years. I was then put into a bad situation where I was struggling to make ends meet. I was cut back to 32hrs a week at work and just kept getting further behind. My Ex was never willing to provide anything more than the $50.00 a week in child support. We agreed that her a her boyfriend would move back into the house and I would move to my parents until I could get back on my feet. This would allow our children to stay in the same school. My daughter wants to move back in with me and I want her to as well. I just want to make sure that I have the right to move her back in.

The child has no rights what so ever except live where the court order says.

She has to live with the parent that has legal custody though the court.

If though the court you have legal custody, that is where she is suppose to be and can move back to you at any time.

If you allowed your ex to have legal custody, she has to stay there, till you go back to court and change custody.

And What means your ex is unwilling to provide support? Did you go to court to have support ordered?
