I am engaged and my fiancé would like to adopt my daughter. She is almost 2 years old and her bological father has never made an attempt to be in her life though I have tried to involve him. He is not on her birth certificate either. I was wondering would my fiancé be able to adopt her without her biological fathers involvement? Or would I still have to notify him and give him the chance to step up?

He would have to be notified, and you and your fiancé would probably have to be married, even for at least a year.

Where are you located? (laws vary)

Yes, I believe GA requires that a couple be married for a year for a step parent adoption.

Also, you have made it harder on yourself by not having him on the birth certificate. The court will require that the bio father be identified and paternity testing done to confirm paternity. Then he will have to approve the adoption.
