I live in California and my roommate, who was on a month to month arrangement just gave his 30 days notice on today the 13 of March stating that his last day will be April 12 and he will pay a prorated rate for April.

However, our spoken agreement for when rent would be paid was for the first of the month, and he has paid rent on the first of the month for his term so far.

I need to find the actual law on 30 day notices for tenants intent tovacate.

From what I remember if you pay rent from the first then you are obliged to 30 day notice at the end of a month. For example if you started paying from the first of the month you would have to give notice at the END of a month to give a proper months notice.

Please help me :)

Hello jill:

You're right. Notice must include a full rental period. In your case that's from the first to the end of the month.

You can find California landlord/tenant law on a sticky note at the top of this forum, if you need the particular paragraph.

Thank you for the reply.

I checked out the sticky but did not have much luck. It did mention giving notice for the full rental period but then it also said something about a pro-rated rate.

Am I looking at the wrong section?
