Two people are under the influence, one a friend, the other is owner of the car. The owner is too drunk to drive so the friend is asked to drive the remaining distance home. On the way, the friend accidentally hit a curb causing extensive damage. Would all blame be put toward that friend even though it was an accident & the Reg. owner was too drunk to finish driving??

Blame by who ?

God? The Police, the courts, the owners wife ?

The owner turns it over to his insurance for the damage. The driver can be held liable for the deductables by the owner

The problem is that the owner has been driving around with no insurance at all and no one knew but the owner.

Then the owner can sue the friend for the cost of repairing the car. To hit a curb is clearly negligent. The fact that the owner did the right thing and decided not to drive does not excluse the friend's negligence.
