View Full Version : Housemate overstays their welcome

I live in the state of Virginia and allowed someone and their family to reside with me due to them having a hard time. We did not have an agreement on time frame or monthly compensation. The living situation has become unbearable and I want to give them notice to leave immediately. Please advise on how to proceed as far as how much notice I can or should be given. I want them out ASAP!

You HAVE to evict them if they have been there more than a month or two. Legally they are your tenant as they have established a residence at that time.

I don't know why people think they have to have anything in writing or have paid anything to be a tenant.

All they have to do is be allowed to live there long enough.

Like the old saying goes... no good deed goes unpunished.

You start with giving them a 30 day written notice they are being evicted and have to leave... properly served... so you can prove receipt in the court... if they haven't left you go to court and have your case heard which after you win the Sheriffs will remove them and their property.


If you get threatened before then... do not hesitate to call the police... I would also do as little as possible to let them be comfortable... password protect the internet.. disconnect the TV from outside the house... do not keep any food in the house... etc... but DO NOT change the locks that will get you in big trouble... you can't do that until AFTER the Sheriffs remove them.
