View Full Version : Divorce, vacation club, maintenance fees. Am I liable?

My husband and I purchased a Marriott vacation club points timeshare in dec of 2011. He then paid off this purchase with his credit card. Both of our names are on the deed that we signed obviously. We divorced in nov 2012. In the divorce decree I agreed to pay a set sum of money to him monthly until we are able to sell the points. He recently received a bill from Marriott for their yearly maintenance fees and he is saying I have to pay for half of it. Another attorney I spoke with said that the divorce decree took presidence over the deed and that if he didn't pay it that Marriott could possibly come after both of us for the fees. He then said that if my ex paid the fees that he could possibly come after me for half but that it would be difficult considering the divorce is already over and the paperwork does not specify anything about maintenance fees or dues, just my monthly Amt and length of time I am to pay him. What are my options? I talked with the vacation club and they stated I could get my name off the deed and transfer ownership of all points to my ex. Of course I know I'm still liable for the monthly payment to him I just don't want to have to now pay for fees and dues yearly.

You need to pay your half. Im sure it was no surprise that this was coming. The longer you stretch it out the more your going to have to pay.
