Should drug dealers be criminally responsible for the death of the drug taker in situations where they have administered or given the drug to the drug taker?

If they have actually administered the drug... rather than just provided it... I think they legally are now.

Consider using the approach of free will... in the former... the second party actually took an action that had a direct cause of the death... while in the latter the individual using took that action leading to their own death.

Compare this to an example... someone walks into Home Depto... buys drain cleaner... goes home and drinks it. Would you charge the Chashier? No... but had that chashier held down the person and poured it down their throat,even if they asked... their role is significantly changed by taking an action that directly caused the death...

Of course that's just an idea... you can work with them... toss in the appropriate legal terminology... and use words that you are comfortible with using.

I'm sure someone will have a better idea... and will present it.

There is another take on that subject that I read about a few months ago in the Baltimore (MD) Sun. The article was about medical examiners in many cases not being able to determine an actual cause of death in drug related deaths. They can determine that a certain drug caused the death but they have no way to tell for certain if it was homicide, suicide, or accidental according to the article, and many are reluctant to make an official ruling.. A person can shoot up, go into some kind of stupor and someone could give them another dose or two to deliberately cause the overdose for instance. When police find a body of an obvious drug abuser they rarely do lengthy investigations.
More good reasons to stay away from narcotics I guess.
