View Full Version : Roommate not on lease is not paying either

I rent a large house and my family are the only ones on the lease. I rented out a room to help me pay the rent. The couple are a month and a half behind on their rent. They told me at the beginning of this month that they are moving at the end of this month. I told them they still needed to pay me the rent they owe me for this month. They said they need it to move. I have been trying all month to discuss with them when they are moving and they are avoiding me. Not answering their door or phone. Do I have to file an eviction to get them out or can I force them to leave because they are 45 days behind and have told me they are not going to pay? They also receive public assistance from the state that is for housing. They are still collecting the assistance but not paying their rent. What can I do? I live in Portland, OR.

How would you "force them to leave"?

First, give them written 72-hour notice to quit. http://foreclosure.laws.com/eviction-process-in-oregon Then, if they don't leave, you may have to sue to evict them.

I know I can't force them to leave without an eviction. I am just frustrated. I'm trying to not have to go through a formal eviction but I'm sure they are going to require it. I have not contacted the state agency. I was hoping that threatening them would encourage them to leave. I am going to make that call tomorrow morning though. I gave them until Nov 1st to vacate or I'm filing a formal eviction. They are only 20 and I would think that fear of having an eviction on their record would be a motivator. It's very hard to rent in Portland with an eviction on your record. They keep asking for my landlords number but since they are not his tenants I don't see how that would do anything. If they call him he will just call me and ask why they are calling him. I have discussed them with him before. Do I have to give them his number? It won't get anything accomplished. He will tell them they are my tenants and not on my lease agreement.

But why, out of curiosity, do you suppose they want to contact your landord?
