View Full Version : Children adopted by paternal grandparents.

My daughter died and her two children were adopted by the paternal grandfather and his wife. They were never in the children's lives. The children do not want to live with them. They get slapped around and have been alienated from there family on the mothers side. The children have to sneak around to see us. What can I do to get custody? Children are 12 and 9.

First depending on where you live, you can file for grandparents rights and seek visits.
The children can report the abuse of being "slapped" and get CPS involved.
Where were you when the adoption happened, was there a reason you did not object or try to get custody at the time

If this was a legal adoption, then they are the children's parents. That means they have control. So there is no way you can get custody unless you can prove there are unfit parents. And that is very difficult to prove.
You MAY be able to force visitation depending on local laws, so I would consult an attorney about that.
Frankly, I don't see enough here to even contact cps. You could get sued if you report this without foundation.
