My daughter will be 2 next month & my ex is taking me to court for visitation /custody rights. He hasn't come to see her since she was 4months old. I don't want him to see her. The only reason he is going is because probation sent him a letter for non payment. He hasn't paid any $ for her. What do I tell the courts at the hearing since he didn't want to see her & he does drugs & I am scared for her to go with him.

Unless you can prove that he's an unfit father, there's really no way to deny him visitation.

Was there a court order for child support? Have you gone to court before in regards to your child and her father?

Did he do drugs when you had sex with him?

Unless you can prove he's a danger to the child, you are unlikely to stop visitation. You may be able to get it restricted to supervised visitation.

You don't "tell" the courts anything. You submit acceptable evidence of unfitness or being a danger.
