Well that is can of worms; no I don't think you can sue if you had sex with the other one willingly, unless of course you were raped.

Not really. The thing is, sex is consensual. STD's are something that's well known, and every person that participates in sexual activity puts themselves at risk of getting an STD. That's the nature of sex.

If you consented to sex, and you're the legal age to consent to sex, than you put yourself at risk.

Also, what do you mean by exposure? Did you get an STD from having sex with this partner, or do you want to sue simply because he/she has and STD? If it's the latter, and you don't actually have an STD, than what are your damages?

I think it only works with HIV, knowing that you're infected and libel to pass it along. Or maliciously passing it on. That is more on the criminal side than anything.

As far as I know you can't sue someone for giving you the clap. Sorry. As litigious as the USA have gotten, I don't think they've gone that far.

I'm not even sure you can sue someone that knowingly has HIV for giving it to you. There was a case not that long ago with over 6 women suing a man that knowingly has HIV, for passing it to them. They lost.

The thing that bothers me about the OP is that she/he doesn't say which STD, and she/he doesn't say that she/he caught the STD. The OP wants to sue for being exposed to an STD. Well, that's called sex. You can't sue someone for having consensual sex with you, and every time you have sex you're exposing yourself to the possibility of getting an STD.
