Hello,

Today I received a letter from a consumer debt attorney offering his for a case that I had no idea I had against me. The Plaintiff is Main Street Acquisition Corp. I haven't called the attorney yet however, I looked up the case at the courthouse listed in the letter. Sure enough there is a case on record. The party information states that the following have been filed:

NOTICE FILED & MAILED
COMPLAINT FILED - COLLECTION CASE
SUMMONS FILED
NOTICE OF CASE ASSIGNMENT FILED AND COPY GIVEN TO PLAINTIFF

An OSC has been set for next year 4/2013.

I have not received any notices other than the letter I received today from the attorney offering to help me.

My question are:

Because I did not know of the case and have not shown up to any court appearances or filings - will this hurt me?
With the above mentioned filings did I have to appear?
I have no idea where the debt originated - How do I find out?
It's likely a valid debt as I have had a terrible time the last few years and have contemplated filing bankruptcy - Should I file bk? Should I try and contact Main Street Acquisition Corp.

Any advise will be much appreciated.

You can hire this attorney or try to deal with it on your own. The first thing you need to do is find out the disposition of the case. If it is still open you need to see if any hearings are scheduled.

Once you know that you will see how to proceed.

First attorneys often find out and know when things are filed before the hearings, and you are likely to get several attorney letters.

If you looked up the case, did you go to court house and see what was status.

Only you know how many other debts you have and how much money you have to pay the debts, or pay attorneys.
