View Full Version : What to expect on sentencing date when given probation?

My husband will go to court tomorrow and his lawyer said he will most likely get probation. What will happen on the day he is sentenced? Will he be drug tested on the same day as sentencing? He two pain killers Sunday night and tomorrow is Thursday. He never took any before that and his crime is not drug involved? I just hope it doesn't show up , it will be four days. Thanks for any answers.

Unless this is a small town court, no he will not be tested.

He will sit in the court room till his case is called, most likely sitting though several other cases waiting on his, and there willl be others sitting listening to his.

They may read the charges again, or that may be waived. If this is a plea agreement, the judge will ask if you have a plea ( he has a plea) he will stands and say yes guilty. If there is a plea agreement in place, then the DA will inform the judge and that wlll be the sentence.

If he has already plead guilty and there is no plea agreement, he is going back just for sentencing most likely and has already plead guilty prior. Then he stands and the judge gives him the sentnece. If it is jail, his attorney can ask for a date for him to turn hisself in, but he could be taken into custody right then.

If probation, in small courts he will meet his probation rep after court often, in larger ones he is given papers on when to report to probation department.

As long as he had a prescription for the drugs, no issue.

Thanks Chuck. Yes, he will plea for the probation instead of going to trial. It's funny you should ask about the small town, we literally live in the deep south and its so small they literally still smoke cigarettes in the jail and courthouse!! These are truly some crooked law officials. Anyway, I just pray everything is done professionally and without bias. Thanks for your reply! God Bless!!

I worked in south GA, small town, cig was how we "paid" inmates for info or other duties, not legally since we were not suppose to give them any.

But where I was at, the PO officer was sitting at a table in the court room, if you got probation and almost everyone did, since they have to pay 30 dollars a month probation fee on top of fines and other costs. When sentenced, they would give you paper work, and sometimes set up for you to see them that afternoon or next morning ( to start getting their probation fee)
