I quit claim deed on my house couple years ago. I still live there but I want my house back. My family members have not paid the taxes like they should and I have been paying them. I heard that since I have been paying the taxes then I should be able to get my house back with no problem and them not knowing. I live in Arizona

Hello 360:

I don't think so. You gave your house away. You don't own it anymore. A quit claim deed will have to be signed by the owner. That's not you.

I could pay the taxes on your house for you. But, that wouldn't give me any rights to your property. I think you heard wrong.

No, you paying the taxes just pays the taxes. You will need to let the taxes go into default and buy it at the tax sale.

Or you need to buy it back and have them quit claim the property back to you.

There is possission by adverse possession in some states, but in that you have to be living there without permission of the owner, so I don't think that applys.

Hello again, 360:

Go see a real estate attorney.

That's not what they said. Who did you quit claim to and under what circumstances? Depending on the terms of the transfer, you might be able to sue for breach of contract and get the house back. For example, if there was an agreement, either written or verbal that the new owners would pay the taxes, then you should be able to get it back.

Your best bet is consulting an atty.
