View Full Version : Immigration to Israel (aliya) with conviction in USA... Possible?

Hello everyone. The question I have is this: Will I be able to immigrate to Israel even though I have a conviction in USA in 2009 (white collar crime)?

P.S. I had a green card until 2009, but, unfortunately, after almost 3 years of fighting for it I ultimately gave up, and was deported to Russia. All my relatives and family live in USA. I just took an interview at the Israeli embassy (indicated I had NO conviction), and the result is in limbo: neither granted nor denied. Maybe I should just "surrender": tell them about the offense and all the surrounding facts?

I really do not know what to do: got used to American lifestyle, but my stupidity finished off better life and future...

You actually have three strikes against you.

Conviction in USA
Deportation to Russia
Lying to Isreali Immigration

I don't think there is any chance of you being allowed into Israel. They have access to all databases and can check if they are inclined to.

Going back to Isreali Immigration and 'coming clean with them' will be another strike against you. They will wonder why you lied and if you did, what other occurrences you could lie about.

If I mentioned about my conviction to Israeli embassy, I should have described ALL facts surrounding that offense to paint a full picture, and so that not just negative conclusions would appear.

What I mean by saying it, is that I signed an NDA, that is a cooperation agreement with US Atty. It said:
COOPERATION AGREEMENT
--"will be maintained under seal"... "the defendant agrees not to reveal his cooperation, or any information derived therefrom, to any third party without prior consent of this office (comment - i.e. US Atty office)"
--in case of breach of agreement "defendant waives any claim that such prosecution is time-barred"
GOVT'S AFFIDAVIT
--"any..disclosure...may pose a risk of personal harm..."
--"govt has filed a motion requesting...any colloquy concerning cooperation agreement and documents filed in support of the motion to seal...be maintained under seal"
--"docketing motion for closure and seal...may create a substantial risk of harm"
COURT ORDER APPROVING GOVTS MOTION TO SEAL
--"...notation... that closure has been sought..could create risk of harm.."

Technically, any colloquy related to my cooperation with US Govt is still under seal for various reasons...

I see, I can't comment on the non disclosure agreement; you can't divulge anything to immigration or you would be in deep trouble is my understanding. I won't ask the reasons you want to go to that country, but you were deported to Russia and you did lie to immigration.

I suggest you hire an immigration attorney if you want to get out of the country legally.

Your situation goes way beyond any advice we can give you here; you can't even divulge here what your situation covered with your NDA. In fact, I even doubt how safe you are even posting here and asking for advice under the circumstances.
