I am getting ready to file for divorce I have been separated for 20 years. I have an order for support attached to a restraining order for $1000 a month for my two children from 1993 that is still in effect that my husband paid nothing for the first 10 years then $200-$300 sporadically after that. He still owes $200,000 in back child support. Sent money after my daughter turned 18 stopped when she turned 21 he paid less than 25% of what he was ordered has put everything he owns in his girlfriend's or business partners name and told a relative he has been claiming he paid full amount $12,000 on his taxes every year. Can I still collect what he owes? I sent for a sealed copy of restraining order with order for support it is from New Jersey we both live in different states (not NJ). He has had a good job all of these years and could have paid he chose not to.

He's making himself judgement proof... because you can't go after assets that are legally in someone else's name...

However... pursue it becaue tax returns can be garnished even if he technically has no assets or bank accounts...

His paychecks could also be garnished... assuming he doesn't work under the table and get paid cash.

The courts are the venue to do this.
