What privacy act, what information and where? Otherwise this is too general to answer.

Most of the privacy acts I've seen cover a government agency revealing the information they gather as a part of the business of government. Other than that, there is little, if any guarantee that information one person or entity knows about you will not be made public.

The key here is not so much whether the info was illegally given, but whether the info can legally be used to prosecute.

But, without know the details, its hard to answer.
