View Full Version : Soon to be separated. Can I be evicted?

I live in Ontario. My wife has decided to leave me for another man. We rent our home from her aunt and uncle. No separation papers have been filed yet.
Can I be evicted either now, or after separation has been filed? What process would be involved, should things go that route?
I pay 90% of the bills but her name is on most of the utilities, if that matters.
Yes, I am looking for another place to live and there is no hostility in the house, aside from some very hurt feelings.

Ask the aunt and uncle outright - can I get the house signed over to me for continuing the rent. Whether they can legally foreclose is a matter called unlawful detainer and that takes an attorney provided they serve you the right papers. Best to find out what their intentions are directly rather than wait for paperwork.

I'm sorry, but I was unclear. Both my wife and I are still living in the house. I'm asking if there is a legal way for her, either on her own, or through the aunt and uncle, to have me evicted now, or after the separation has been filed.

The first question is whether you have a formal lease with the owners.
But either way, they can evict you as long as they follow local law. This means proper notice to vacate (generally at least 30 days) and a follow up with filing in housing court for an eviction order.
Having a formal lease may make it harder.

Agree, is there any type of formal rental agreement, or lease agreement with the property owners in both your and wife's name ?
Is it all verbal ? Is it all if written in wife's name.
Those issues will help with answer.
