My husband is non biological father of 15 year old girl, but was married to her mother when she was born and signed birth certificate. Mother left child with him at age 3 and they divorced. The Court isn't going to get involved with why your husband never asked for support from the non-custodial parent. The Court is only going to consider the mother's request for support of the child now.

There was no Order for the mother to support the child. Therefore, she was under no LEGAL obligation.

I understand your frustration. Is there a Court Order that your husband is the custodial parent? If not, there should be an Order before the child returns to the mother or this situation will bounce back and forth - child here, child there.

A Court needs to address this.

If the mom goes to court and is awarded custody, the court will also rule that your husband will pay child support.
