You need to go to court to get an order of temporary guardianship. Do this in a VA court. The letter from your sister may help or she may be able to appear by phone.

Where is the father?

The school hasn't heard of the new technology available now? It's called a fax machine.

The school may not accept the child's residence without a court order. If the question is whether the mother gives permission for the niece to go to school in VA, then yes, a fax or e-mail should be able to get this resolved.
