View Full Version : Is it illegal to fake a harassment charge & can I make the accusing party pay

I live in the UK and iI am going through a divorce . I had to leave the marital home because it go unbearable to stay & I felt my life may be in danger because of the wife's mood swings . I have an 8 year old daughter who I was seeing during the week and weekends which went down to weekends every other weekend . I now live with someone else & on a regular basis I would phone my daughter to speak to her that then went down to about ones a week the I would only get an answer phone . ON May 13th was the last time that I saw my daughter for the weekend & at all , I went on holiday & when I went to pick up my daughter on May 26th there was no answer . I phoned all the phone numbers that I could think of & just got answer phone after answer phone , so I went away thinking that the wife was being stupid & gone out to stop me seeing my daughter . On May 27th I went again , same again no answer again phoned again went away same reason as the first . Later that day I went to visit my mothers & on the way back I went to see if she was back , there was no lights on the house looked deserted so I had a look around the back of the house & the back door was open . So I phoned the house left a message for her to let me know what was happening if they were in & if not & the place had been broken in to if anyone was there to let me know if there was anyone else in & if so are they OK , obviously getting worried for my daughters safety (& the wife) . I then called the police who told me not to go in but to wait out side ,so I waited out side & to my surprise one of her friends boy friend came around to threaten to beat me up & put me in hospital or pore petrol over my & set me alight . Just then the police arrived & actually witnessed the verbal abuse & threats from the person who had been drinking & drove a car to get there & did nothing about mean while the lights went on the front door opened & they where in all the time .So I explained to the officer what was happening as above all weekend the police officer went in to the house the wife was doing a lot of shouting & waving arms then the officer came out ( this is where it went all wrong for me ) he issued me with what he called an interim harassment order & told me I was no longer to call at the house not even phone the house < so now my daughter probably thinks that I have abandoned her which I haven't . I have been trying to get legal aid but it is taking some time but is it illegal to fictitiously make up harassment charges on another person who has been very reasonable & only wants to be a father to his daughter . & can I make them pay .

It's a crime to file false criminal charges. I don't know what "make them pay" means.
A separate civil lawsuit?

Gosh I feel for you. I know the feeling. I am sort of going through the same kind of thing. I want to leave the house because it is unbearable but I don't want my children to think I've abandoned them. I know he is going to lie lie lie when he is served divorce papers. What can we do?? Million dollar question...
Sorry, I don't have an answer for you, but I do sympathize with you and hope things work out so you will be able to see your child.

Sorry, i don't have an answer for you, but I do sympathize with you and hope things work out so you will be able to see your child.
I'd be less worried about what your children would think if you leave and MORE concerned about what the Court will think.
