View Full Version : What right do I have as a father and not on birth certificate?

My wife did not put me on the birth certificate, and we were/are still married. She left the city we were in when she was 8 months pregnant w/my son and did not tell me. Once I found out, I relocated so I could be apart of my sons life. I thought we were working things out, but apparently she is in a relationship. I've had my son for a month and I've been asking her if I could have him for the weekend. She now is telling me that she has given my son up to her aunt because she joined the military. What am I to do to get my son? HELP.

In most states in the US you are assumed the legal father if you were married even if she did not list you, It is also wrong and perhaps illegal not to list you as father if you are married in some location.
You have all the same rights, you stop talking with the ex, hire an attorney file for custody of the child in court.

Check with the state vital statistics bureau, if you can prove you were married when the child was born, you may be able to have the birth certificate amended without going to court. Generally the hospital fills out the birth certificate and if she said she was married, they should have listed you. So she may have lied to the hospital.
