My dad passed away in 2005 leaving a will. I was not named in the will. A couple years after his death, my mom named me as a benificiary on a bank cd account. Recently, my mom passed also. Everything is now in an estate account and my sister is the trustee. Am I entitled to my portion of the cd account ?

The CD would not go into the estate but go directly to the benificiary.

My mom had a lot of Medical bills that were unpaid, that is why the estate account was opened.

Are you asking about a beneficiary or a co-owner?

My dad willed the house and property to my brother and sister, and he also had bank accounts which I assume was also willed to them. After his death, my mom named me as one of the benificiaries along with my brother and sister on my dad's CD. My mom passed recently and because of hospital and doctor bills, the CD was placed in an estate account until those bills could be paid. My question is, even though I am not named in the original will, but was named benificiary to this CD after my dad's death by my mom, am I entitled to my third of it?

If you are the direct BENEFICIARY of this CD it should not be in the estate account and would pass directly to you, outside the Will, the same as an insurance policy.

Yes, life insurance and CD where there is a named beneficiary does not go into the estate to pay other bills, the beneficiary listed would have gotten all of the money directly
