H. I am pregnant w/ my first child and in serious credit card debt. I tried to make payment arrangements for what I could afford w/ my creditors, but after approx. 3 months they wanted more than I could afford. I am in the process of selling my house for what I owe on it because I cannot afford it and do not want to be foreclosed on. My question is, one Credit Card(Citicards) actually called my work and did an asset investigation. Can they put a lien on my house before I sell it? Can any of my credit card companies sue me or garnish my wages? I really would like to work with all my creditors, but once you fall behind they are not very helpful. What happens if you simply cannot pay? I need to keep a roof over my head and food on the table for me and my child to be forst and foremost.

Most states do not allow a lien on a primary residence for unsecured debt. They also would have to get a judgement against you before any lien could be placed.

But yes, they can sue you if you don't pay and they will obtain a jhudgement against you if they sue. Once they receive a judgement they may be able to garnish your wages (depending on where you live) attach your bank accounts or other assets.
