Its definitely not a smart idea to leave your daughter for 3 whole months just so you and your boyfriend can get a new place. Why would you have to leave her for that long for that reason? I don't know for sure she could keep her. Each state is different but there is a good chance of it. But honestly moving a boyfriend in with that kind of a charge could have the courts question who's best interest you are looking out for. You also said you can't take the emotional abuse by your mother... but you would leave your child alone with her for a few months? I don't know your full situation but for your daughters sake I would come up with a different solution and rethink my boyfriend. That charge is always going to be able to be used against you when it comes to your child.

She could sure try, show you are unfit, and living with someone it appears the court does not think you need to be around.

You have made a lot of poor choices in the past, it appears you are starting to make a lot more.

You get a job, you make a life and move with the child, not leaving the child.
