My kids father is out of the picture, he hasn't seen them in over six months. Child support is ordered but he's only paid 60.00 since 2008. I'm recently engaged and my children call him daddy. Is there any way I can have my ex's rights terminated? By the way, I live in Ohio

In general, no. Have you gone back to Court to enforce the child support Order?

After you are married (and the Courts usually require a marriage of over a year) your husband can file to adopt the children, but the consent of the father will be required.

What do you hope to accomplish by terminating his rights? He undoubtedly will get agitated (or downright angry) and start coming around to visit them again. Right now you don't have to deal with the problem because he's not coming around.

I'd wait, get married, ask your husband to adopt the children and fight the battle then.

I just want him out of my children's lives for good. I know that sounds harsh but he's a drug addict and drinks all the time. I fear that he's going to show up one day and try to take them. (we were never married so I have full custody right)? I just went to court a few weeks ago for the child support (he didn't show up). And because my children were born in different countys, they denied child support for my youngest son. (yes we had a paternity test done and he is the father).

This is difficult to understand because it's kind of 2 explanations of (sort of) the same thing but he does have rights as the biological father. He needs to go to Court in order to exercise those rights.

With me so far?

As their father he's "entitled" to visits with his children but he has no visitation rights until he goes to Court and gets an Order enforcing those rights.

If and when he asks to see the children unless he has an Order giving him permission you can refuse. He can, of course, then go to Court and request visitation and you would have to PROVE that he's a danger to the children, emotionally, physically, some other way.
