View Full Version : Rear ended but the other insurance says they may not have to pay.

Please help. We were rear ended a week ago. The other driver was cited and found at fault. When we contacted her insurance to begin to get our van fixed they said she might not be insured because the vehicle she hit us in was a new purchase and not on her policy. They said they cannot get a hold of her and are dragging there feet. My wife and kids have back and neck pain/problems now and we only have the one vehicle, which drives but has extensive body damage as well as transmission issues now. We don't want to file on our own insurance because we have a $500 deductible and can't afford to go that route. How should we proceed?

They are blowing hot air. She is personally insured by them no matter what car she is driving, this covers liablity. They may not be required to fix her car because she did not register it with them, but she's registered personally.
