My ex some how another has changed my 2 boys name to her. Now husband and I owe back suporrt. I have been on ssi since 1998 and can not work and only receive 698. Monthly to live on. They r now well above 18 and both have been in military as I. Will I be incarserated for back c/s for not being able to pay in tx?

Do I have this right? You have 2 children with your "ex." She changed the boys' last name from your last name to her last name. Was that Court ordered?

Then you say "your husband." Were you in a same sex relationship and now you are in a relatonship with a man? Something else?

No, you won't be incarcerated but you DO owe back child support. Was support Court ordered? Did you ask for a reduction based on changed circumstances when your income level changed?

Supplemental Security Income (SSI) benefits are based on income. The non-custodial must go back to Court if income changes - for example, the person is no longer employed and collects SSI benefits he/she must go back to Court and ask for a reduction in child support. It is entirely possible that no support will be ordered, depending on the income level.

Child support ARREARS will still due and owing, no matter how the non-custodial parent's income changes.

The Social Security Administration says this: "Social Security will garnish benefits: - To enforce child support or alimony obligations under 42 USC 659."
