I live in ga... this lady filed a intentional fake police report on me for terroristic threats and I was able to get an detective to obtain an application for an warrant hearing... the person was served by the detective himself as I witnessed... when it was time to appear in court... she did not show up... so the judge said there was no record in the courts that she was actually served... so she had the court

To reserve her and scheduled the case for two weeks later in which she returned the notice unopened trying to pretend like she does not live there... the judge dismissed it... knowing she has been charged with obstruction of an officer for this same behavior.

I'm not quite following. You have a suit against her? For What? Or is it a criminal case for filing a false report? In any case, why would a judge dismiss it because she didn't show? The judge should issue a warrant for her arrest for ignoring a summons.

It's a criminal case... she said cause it came back unopened... which means she was not suppposively notified.

So ask that a warrant be issued! What would it be like if someone could get away with a crime by ignoring a summons? Where was the prosecutor in this?

So you went and filed this, the DA did not press charges. Had the DA found evidence enough to follow up, he would have issued an arrest warrant, not a notice of service?

It is very strange for you to be present when a notice is served on the party that you are trying to have arrested ? Are you two living together in some manner? Could the judge or DA believe this is more domestic ?

Next there is not such things as "international fake police report" International does not exist, they can file a police report in England, or in France, or in Canada. There would be a police report file at some specific country, under that's countries laws.

Chuck, the OP didn't say international fake police report, she said intentional fake police report. Just fyi. :)

The reason I was present was because the detective served it to her after another trial we had together and the reason he did that way because of what she is doing now... whenever the sheriff came to her house she would either nt open the door or have her kids lie and say she was not there.

And in ga.. that's what a warrant hearing is... u (the victim) present your evidence to the judge and that's when him/her can decide if a warrant will be issued or not... the defendant does not have to be present... or they can... but if u prove they did the crime a warrant will be issued or they will be arrested on the spot in the courtroom.

But this really makes no sense. If a detective personally handed her a summons, he can testify that she received it. But in any case a criminal case, is handled by a prosecutor. And a prosecutor would ask for a warrant to be issued for a no show.
