View Full Version : My estranged husband is driving my car how can I get away from him

Soon to be ex husband in jail with a restraining order has my car and I can't get it back what do I do. I've talked to the police and they've been no help at all. My license is suspended because he didn't pay two toll violations. HELP!!

Is the car in your name, or both you and your husbands?

It's under my name but the police won't do anything about it. I'm scared to get more tickets or that someone has an accident and I'm liable

If it's under your name only then I don't understand why the police won't help. Just report the car stolen.
They can't settle a property dispute between husband and wife, but a stolen car, they can take care of that very quickly. Of course that would mean legal trouble for your husband, but if you've made every effort to get it back, and he won't, I'd report the car stolen and let him face the consequences.
Keep in mind that I'm not a legal expert. Hopefully they'll be along soon to tell you an easier way to get this vehicle back.

They say that in the state of Florida is shared property. He'll be in jail at least until feb 2013. My divorce is in process but I'm afraid that I'll be involved in some kind of trouble if I don't get the car back. My license is already suspended because he didn't pay two toll violations. I have a permanent restraining order from the court. I don't understand what the problem is??

I'm sorry. I really don't know what to tell you.
We have wonderful legal experts on this site, but we all volunteer, and it looks like they're all offline right now.
Please check back later today, hopefully one of them will have seen your question and they'll be able to give you better advice than I could.
Frankly, at this point I would steal the car back. But is it really stealing if it's your property, in your name? If they can't take it back from him when he stole it, then they can't do anything to you for stealing it back, right? But that's probably not the best advice, and I urge you to wait until the legal experts come online. I don't want to give you advice that lands you in jail.
I'm sorry you're going through this, and I understand your concern. It's not right that he should be allowed to do this. I wish I could give you better advice.

I really appreciate your help. If I knew where the car was believe me I would get it, but I suspect it's at his mother's house and they are all against me now because after all he's done to us he's the victim now. Thanks. Again

I only wish I could give you a solution. Maybe the legal pros here will have a solution.
While you're waiting why not take a look around the site, see if there are any questions you can answer? That's how most of us started here, and we ended up sticking around. :)
I hope you find a solution. I also hope the divorce goes smoothly. Sounds like you're getting out at the nick of time.
