My wife and I have been together since he was 10 months old. This guy has seen him maybe 3'xs since. About a year ago he sent us a message on Facebook saying that it would probably be best for him(our son) to just sing over his rights. We are perfectly fine with this, we (our son included) wanted for me to be his legal father and also have him have my last name. We live in Arizona and he live in Maryland. Any help or suggestions would be great!!

Want that to happen... get married and have your new husband adopt your son. His rights end with the adoption. As do any future financial obligations.

Otherwise its not going to happen.

OK, so what you do is get an attorney and file for adoption. As part of the adoption process, the bio father will be contacted to relinquish his rights. As long as the bio father and your wife (the mother) and the child are all agreeable, this will be a simple process. But you still need an attorney to make sure the paperwork is done right.

By the way your title and post are contradictory. In the title you refer to YOUR son's father. But in the post you make it clear it is your step son. Just wanted to clarify.
