View Full Version : Can my husband kick me out of the house? What are my rights?

I live in Texas. We have been together for 7 years but only married for 2 years and we have a 5 yr old son. He has already locked the bedroom door so I can get any of my stuff and he took the car. I've been a stay at home mom/wife with a part time job that I just left from to go back to school.the house,car,truck and money is all in his name. Please help and let me know my rights. I don't have anywhere to go and I have my 5year old son to think about. My sons already upset because my husband told him "mommy and you are going to leave my house". He's says I need to leave today and make an appiontment with him to come back for mine and are sons stuff. Please help me any anyway you can thanks

Call an Attorney - no, you cannot be thrown out of the marital residence. Doesn't matter whose name anything is in - that's for a divorce Judge to decide.

He can't make you leave. If he tries, call the Police.

He can force you out, but ONLY if a Divorce court signs off on it. So, if he tries to lock you out of the marital home, call the police. And if he is pulling what he's pulling, consult an attorney today.
