Hello,
I am married now for 12 yrs. And reside in IN. can my husband kick me out of the home if my name isn't on anything but a car?

He can't kick you out... but he can have you evicted if its in his name only.

They end with being you not in the house... but they are both very different things.

Don't let him find out the process needed...

Legally its HIS house... and if he's smart enough to find out how to do it.. there isn't much you can do.

Might want to make plans on where to go if he does do it. Or at least work on defusing the situation that has obviously escalated to this point for him to want to do it... whatever that might be.

If he had this house before you married or he inherited it... you have no claim to it even in a divorce.

First, if you have a follow-up, please post a response to this thread, don't start a new one.

NO ONE can be "kicked out" of their home. The only way to get someone out of their home is through the legal eviction process. However a spouse cannot be even evicted from the marital home unless a divorce settlement gives the house to the other spouse.

There is nothing you can sign to protect you, nor is anything needed to be signed. But if you fear this happening, then go see a divorce attorney.
