View Full Version : Filing taxes when I am on H1 and my wife is on H4

Hi,
I have been on an H1 since 2003 and I got married in August '06. My wife came here on Oct 5th. I read through the instructions and concluded that we can file jointly (even though she doesn't meet the substantial presence test) for 2006. When I filled the 1040, I realised that I owe $5000 after all the exemptions etc. Now, the question I have is how do I file the taxes. Do I submit my tax return with the W7 and also attach a check with it ? Or do I have to submit 1040, W7, my wife's notarised passport copy, then wait for IRS to process it and send me her ITIN and after that file 1040 again with the check to a different IRS center? I am located in Texas and I don't have to file state taxes anyway. Please help me

File the tax form with the W-2 and a check attached.

The IRS center in Austin, Texas can process the check just as easily as any other IRS center.
