I was receiving CS from my ex
Husband until my son turned 18 on 11/11/2011. My exhusband called me and said that the CS agency made a mistake and overcharged him. The CS agency made arrangements to pay him back by removing money from my taxes... Is this true?. If CS made a calculation error is the custodial parent supposed to get penalized?

If he overpayed and you accepted the payment then yes you owe him the money. How much was the overpayment ?

Yes of course, you are not getting a penalty, you are just expected to pay back the money you received in error. If you had a pay check and they over paid, you, and you did not say anything, then you have to pay it back.

Not sure why you fail to see that you owe money back that you were paid in error. If you don't want it held out of your taxes, just write them a check for it.

Actually, the CS was taking money out of his account. When I would see that I received more money I contacted CS and they would tell me that its back pay that he owed me.
