View Full Version : My boyfriend's ex is trying to take him to small claims again??

Hi, so here's the sitaution. Last year my boyfriend went to small claims with his ex because they were on a lease together. When they broke up, he moved out. She didn't pay the rent and ended up moving out too. So the lease was broken and the management is suing her for the amount that she owes. So he agreed to pay her half the money since he had no proof that he did move out and has been paying it on time every month.

Fast forward to today. She txted him earlier this week saying that the dog they had was sick and she needed money for medical expenses. He felt bad for the dog so he agreed to give her money if he had anything extra this week. He didn't, so she txted him back and got nasty, saying he still owes her more money. She claims that he owes her all the money for the furniture they bought together, which she had kept and sold later. Can she really go to small claims with this? She kept the furniture. Why should he owe her for it if she decided to sell it later?
Also, can we file a harassment suit against her? She texts him all the time telling him that she misses him and stuff, even though it's been three years. Can we arrange a restraining order? We just want her out of our life. She is a psycho. What can I do to make her stop and go away?

ROs don't cover texting. If he can't figure out a way to keep her from contacting him, he isn't trying hard enough.
If what you say is true about the furniture, then he has nothing to worry about. It certainly doesn't make sense that she could charge him for furniture she sold. Maybe she thinks because it sold at a loss, he owes her for the difference. Not so.
And the vet bill... he needs to stop being so wishy washy. Either he wants to help out for a while or not. Three years sounds much too long to me, and if I were YOU, I would wonder a little about his willingness to be so helpful to her after all this time. It's time he completely severed all ties and contactability.

Thank you for the response. You've made me feel a little better about her threatening to take him to small claims for the furniture.

Oh I forgot to clarify about the vet. He actually was going to send her the money to help but I guess he didn't send it quickly enough to suit her so that's when she got nasty. It turns out the dog was never sick. She just told him that because she needed money because she's in credit card debt. She admitted it while txting him. He has a soft spot for the dog since he was the one who got it for her as a puppy. So now she's trying to find new ways to squeeze money out of him by claiming he owes her for everything they ever owned, even though she was the one who kept everything after they broke up.

Sorry about the rant. So just to clarify, when you're in a relationship, and you split costs for things, if it's just her name on it, she can't come back later and say he should pay for half of everything? She apparently is a shopaholic and I'm afraid she's going to find some way to claim that he owes for all her cc's when her name was the only one on them, just because he lived with her for a while.
