I am 19 and work fulltime. My sister is 17 and is starting her junior year. Recently my mom brother and I found out my sister was molested by my stepdad a few years back and since we have always had problems with my mom for not knowing how to care for us I had enough and moved out with my little sister but I want to know how I can have legal custody or guardianship of my sister because my mom told assistants at her school that she wasn't living with her anymore and they kicked her out. I want her to continue school but I need to know what I can do. Please help.

Is she still in the same school district if she is living with you ? That will settle the school question. As far as guardianship goes if your mom is willing to assign guardianship to you then you will be responsible for your sister. Also as a side note. Has your sister come forward with what has happened and was he arrested for it? Depending on where you live there is no time limit for molestation of a child.

If she is already registered in school then there shouldn't be a problem. If you have to register in a new school then you will have to get temporary guardianship. If mom won't sign then you have to go your local Family Services agency. If someone at school can testify that the mom said she was kicked out, there shouldn't be a problem.

I agree with califdad that this should be reported.

She is registered by she's trying to Te her classes because she's returning from summer break but hy aren't letting her start again if she Isn't living with my mom. I have to have papers to show that say she is in my care now.
