Hi,

My step-father died 4 months ago with no will. My step-father and biological mother were married for 30 years before he passed. They have been divorced for around 15 years and her name was still on the bank loan for the house (in Florida) he lived in (which was part of their divorce agreement) that he kept that house since she moved back to (Indiana) where her kids live. But, her name was not on the actual house documents from what I understand. He has five biological kids that have come back into his life after my mom and step-father divorced and they were in charge of his burial and the selling of his home. The house was sold for $250,000 (Naples, FL). So, my question is, will everything go to his biological children or do we as his step-children of 30 years have any legal rights to his estate since he left no will? Three out of the five step-children kept in touch with him and made trips to Florida to see him on occasion and we also went down to Florida for his funeral.

Step-children inherit nothing unless they are named in a will.

And, technically, you are ex-step-children.
